Photo Session Agreement

Parties
This agreement is between Stephanie Byrd Photography, LLC (also referred to as “Photographer”, "we", or "our") and the signer of this agreement (also referred to as “Client”, "you", or "your").

Entire Agreement
This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements. Any changes must be in writing and signed by all parties.

Reserving Your Appointment
A payment of any amount indicates your agreement to all terms of this contract. Full payment of the session fee is required to reserve your session time and date. If the balance is not paid in full, Photographer will not photograph the event or session with no liability to Photographer for loss of payment or deposit.

Love Your Photos Guarantee
Our Love Your Photos Guarantee consists of three parts and is solely governed by this contract.

Scheduling Guarantee
When Photographer first contacts you to schedule your session, if the date you wanted isn’t available and you do not wish to schedule a different date, we will issue you a complete refund. After you confirm your date, your session is then subject to our normal cancellation policy described in this agreement. If you book a session online and we contact you to schedule your date but you do not reply back with your preferred dates within 10 days, we reserve the right to cancel the session and issue you a refund.

Good Weather Guarantee
If the Photographer cancels your session due to weather, we’ll give you the option to reschedule to another open date or receive a complete refund. The discretion whether or not to cancel for weather is the Photographer's, and we generally do not cancel sessions due to normal seasonal temperatures.

Happy Family Guarantee
We will send your digital images to you through an online gallery or digital download link. If you are not satisfied with your images for any reason and you let us know within 10 days of receiving your images, we will offer you one free re-shoot of your session. You must schedule this free re-shoot on an available date within 60 days of your original session. The new images will be added to your online gallery and you may keep the images from both sessions. However, we will not replace or refund any printed products that have already been shipped.

If you opt for a refund due to our scheduling or weather guarantees, we will issue the refund within three business days. When any refund is issued, please understand that we cannot be responsible for how long it takes for your bank, card issuer, or the payment processor to process the refund once issued.

Cancellation Policy
Cancellation requests must be received in writing (such as an email or Facebook message to our business accounts). If you cancel at least 60 days before your session date, we will give you the option to reschedule or receive a refund. After this time, the session fee becomes non-refundable.

Shooting Time & Wardrobe Changes
Client & Photographer agree that cheerful cooperation and punctuality are essential to a good photo session. Shooting commences at the scheduled start time. Any wardrobe changes during the shoot count towards the allotted time. We are unable to permit wardrobe changes during the Petite or Spirited sessions due to their brevity. If anyone in your party makes a wardrobe change during a Petite or Spirited session, it voids the guaranteed number of images advertised for the session.

Copyright
Photographer retains the copyright to all photos and digital negatives. Photos may not be edited by the Client for any reason. Packages that include printing rights are for personal use by Client only. If you have purchased a digital download of your images with a print release, you may freely shares these digital images with friends and family; however, only the person(s) named in the print release will have printing rights. You may also post, share, and tag photos your purchases images on social media. If you love us, please tell your friends about us and consider tagging our Facebook page or website!

Model Release
Client hereby grants to Stephanie Byrd and Stephanie Byrd Photography, LLC the irrevocable and unrestricted right to use and publish photographs of Client and all guests for editorial, trade, advertising, and any other purpose and in any manner and medium; to alter the same without restriction; and, to copyright the same. Client hereby releases Stephanie Byrd and Stephanie Byrd Photography, LLC from all claims and liability relating to said photographs. Client also affirms that any persons photographed during the session have been informed about this release by the Client and have given their express consent to this model release clause and that the Client has the legal right to convey their consent. Client also attests that either they are the legal guardian of any minors being photographed and grants consent on behalf of the minors to all terms of this contract including liability release; or, that the person signing has obtained the consent of the legal guardian and has been given the guardian's authority to consent to this agreement.

Exclusivity / Guest Photography
No one but the Photographer may take photos during the session.

Cooperation & Conduct
Client is responsible for the conduct of their guests and children. Coordination with 3rd party vendors is also the responsibility of the Client. Photographer will not tolerate verbally or physically abusive behavior. Such behavior will result in termination of all services with no refund.

Liability
In the unlikely event that Photographer is unable to complete services for any reason other than an act of the Client, we will refund all payments made by Client for the session. In the event of physical or personal damages or the inability to perform in this contract, the maximum liability of Stephanie Byrd Photography, LLC will not exceed for any reason the refund of all payments made for the session. Client and all guests agree to hold harmless and waive all personal liability from any individual member, owner, employee, or manager of Stephanie Byrd Photography, LLC. Client and guests participate at their own risk, and Photographer is not responsible for any injury, illness, or disease that results from participation. Client assumes sole liability for all minors participating in the session.

Severability
If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole is not affected, and the other provisions of the agreement remain in full force and effect.

Selected Package
The package you will receive is the one that is indicated on the receipt for your payment. Check your receipt carefully and match the payment amount to the following:

Petite is $189 + tax and includes a 15 minute session and 8 digital images with a print release.

Spirited is $249 + tax and includes a 30 minute session, 20 digital images, VIP pricing on prints, and one coupon code for free shipping on an order from your online gallery. The free shipping code can only be redeemed one time.

Signature is $349 + tax and includes a 60 minute session, 45 or more digital images, VIP pricing on prints, an 11x14 mounted stand-out print, and one coupon code for free shipping on an order from your online gallery. The free shipping code can only be redeemed one time.

There are no travel fees for locations in Wake or Johnston county. A nominal travel fee may apply if the location is outside of these counties and more than 45 miles from the Photographer's residence. We will inform you if your requested location would incur a travel fee before confirming the location for your appointment.

Electronic Signature & Agreement
Client agrees that an electronic signature submitted on this form is legally binding. You attest that the mark made by you on this form indicates your acceptance of all terms of this contract.
